Work permits for foreigners

How to get a work permit?

To obtain a work permit, the following documents are to be submitted:

  1. Apostilled / legalized documents (for CIS countries - notarized copies) with a notarized translation into Russian, confirming the required level of qualification of the employed specialist (higher education diplomas, certificates, etc.) to whom the Work Permit will be issued.
  2. Professional records of a worker (in accordance with the eligibility requirements for length of service and the relevant profession) on the official letterhead of a previous employer, signed by the director.
  3. Copy of the passport of the worker with a notarized translation into Russian language.
  4. In case your company previously received permits and your company have a particular condition, you shall submit proof of their performance in a timely.
  5. Notarized copies of the constituent documents of the company (Charter, Certificate of registration / re-registration).
How to extend the work permit?

To prolong a work permit, the following documents are to be submitted:

  1. A copy of the passport of the worker with a notarized translation into Russian language.
  2. In case your company already has special conditions, it is necessary to submit documents to implement them (a copy of the Reconciliation sheet of special conditions on the settlement with the employer).
  3. Notarized copies of the constituent documents of the company (Charter, Certificate of registration).
  4. Notarized copy of the work permit of a foreign specialist.
How to replace a work permit?

To replace a foreign specialist according to work permit, the following documents are to be submitted:

  1. Apostilled / legalized documents (for CIS countries - notarized copies) with a notarized translation into Russian, confirming the required level of qualification of the employed specialist (higher education diplomas, certificates, etc.) to whom the Work Permit will be issued.
  2. Professional records of a worker (in accordance with the eligibility requirements for length of service and the relevant profession) on the official letterhead of a previous employer, signed by the director.
  3. Copy of the passport of the worker with a notarized translation into Russian language.
  4. Notarized copies of the constituent documents of the company (Charter, Certificate of registration / re-registration).
  5. Documents that guarantee termination of the employment contract / agreement with a foreign specialist, as well as documents guaranteeing his trip to the country of residence (notarized copy of passport with a stamp of canceled work visa, exit visa, a copy of air / railway / bus ticket, a copy of the order on termination of the employment agreement / contract with a foreign expert, to whom the work permit was issued).
  6. White copy of work agreement.
How to make a duplicate copy of a work permit?

In accordance with clauses 65, 66 of the Rules for changing data of the foreign worker ( name, surname, passport data), or the Employer's data ( name , bank details , etc.), duplicate permits for foreign workers are to be obtained.

Within ten calendar days of the change data of foreign workers or employers, an application for renewal of the permit with copies of documents confirming the above information is to be submitted to the authority.

Authorized body within five working days from the date of application shall issue a duplicate assigning a new number and marking this document "Duplicate".

In case of change of the data of the foreign worker (name, surname, passport data), the following documents are to be submitted:

  1. White copy of work agreement.
  2. Copy of the passport of the worker with a notarized translation into Russian language.
  3. Information about the foreign employee (with updated passport data).

In case of change of the data of the Employer (name, bank details, etc.), the following documents are to be submitted:

  1. Copies of documents confirming the said information (notarized copy of the order (reorganization), a copy of the certificate of state registration).
What documents are necessary to close the deposit?

Refunding a Return margin (deposit) from the Bank

In the case of the expiration of the permit or the dismissal of a foreign worker and his departure to the country of permanent residence, the company has the right to return the down payment (deposit) of the bank. To do this, the Employer must be received in the Office of Employment and Social Programs appropriate authorization letter. The authorized body within 10 days of the date you issue a permit for the removal of deposit.

In the case of the expiration of the permit or dismissal of the foreign worker, the following documents are to be submitted:

  1. Copy of the order of dismissal of an employee.
  2. Copies of the traffic ticket or e-ticket (hard copy).
  3. Original certificate from the bank of a security deposit that was open to the employee in obtaining permits.
  4. Copy of the bank agreement, confirming the opening of a security deposit.
  5. Copy of work permit.
  6. Copy of passport with a stamp of canceled work visa and exit visa.

 

Rules define the procedure and conditions for issuing permits to foreign workers for employment and for employers to hire foreign workers. Employment of foreign citizens is performed on the basis of quotas established by the Government of the Republic of Kazakhstan.
